Effective October 29, 2026
Terms of Service
These Terms are an agreement between you and Bleu Technologies Inc. ("Bleu," "we," "us"). They cover the usebleu.com website and waitlist, the Bleu apps for Mac and iPhone, Bleu Cloud, and everything Bleu does for you (the "Service"). Section 19 says that disputes will be resolved by individual binding arbitration, and that you waive class actions and jury trials. You can opt out of arbitration within 30 days of first accepting these Terms.
1. Acceptance
By using the Service you agree to these Terms and our Privacy Policy. If you don't agree, don't use the Service.
2. Eligibility
You must be at least 18 and able to form a binding contract. If you use the Service for an organisation, you confirm you're authorised to accept these Terms for it, and "you" includes that organisation.
3. Description of the Service
Bleu is an AI assistant for your Mac. It searches the sources you connect (such as mail, messages, calendars and files), answers questions, makes suggestions, and acts for you: it can operate a web browser, sign in to websites, fill in forms, send emails and messages, manage calendar events, and use apps on your Mac. Parts of the Service run on your Mac and parts on our servers, as described in the Privacy Policy. We may add, change or remove features at any time.
4. Early access
The Service is in early access. Access is by invitation from the waitlist, and we may limit or end it at any time. Early-access features may be incomplete, change without notice, or contain bugs, and may lose data. Keep your own copies of anything important.
5. Your account
You sign in with a Google account. Keep your Mac, accounts and devices secure, keep your information accurate, and tell us promptly at legal@usebleu.com if you suspect unauthorised use. You're responsible for everything done through your account, including actions Bleu takes on your instructions.
6. Connected sources and integrations
When you connect a source (for example Gmail, Google Calendar, Google Drive, Outlook, Messages, Contacts, Photos, GitHub, Slack or Canvas) or grant a macOS permission, you authorise Bleu to access and use that data to provide the Service. You confirm that you have the right to give us that access. You can disconnect sources at any time. Your use of third-party services stays subject to their terms, and we're not responsible for them. Our use of Google user data follows the Google API Services User Data Policy, including its Limited Use requirements.
7. Actions Bleu takes for you
Bleu acts as your agent, on your instructions. You are responsible for the actions Bleu takes for you and their consequences, including emails and messages it sends, forms it submits, calendar events it changes, purchases or bookings it makes, and changes to your files or accounts.
- Approvals. Bleu asks you before it sends, submits or pays for anything. Read what it shows you before you approve, especially messages to other people, payments, and anything that can't be undone.
- Auto Mode. If you turn on Auto Mode, you approve in advance the actions Bleu takes until you turn it off or Bleu restarts. Use it only for tasks you're comfortable having done without review.
- Messages to others. You're responsible for what Bleu sends in your name, and for following laws on unsolicited messages, consent and recording.
- Transactions. When Bleu makes a purchase, booking or other transaction for you, you're the party to it, not us, and the merchant's terms, prices and refund policies apply. We aren't responsible for orders, charges or bookings made at your instruction or with your approval.
8. Passwords and signing in for you
If you let Bleu use logins saved in Bleu Passwords, 1Password or your browser, or read one-time sign-in codes from your messages or email, you authorise Bleu to sign in to those websites as you. You're responsible for making sure this is allowed by those websites' terms, and for what happens in the accounts Bleu signs in to. Bleu fills a password only on the site it was saved for, and never sends passwords to an AI model or to our servers.
9. Fees
The Service is currently free. If we introduce paid plans, we'll tell you the price and terms before you're charged, and you won't pay anything unless you agree to them.
10. Acceptable use
You agree not to use the Service, or have Bleu act, to:
- break any law, or infringe anyone's privacy, intellectual property or other rights;
- access accounts, devices or data you aren't authorised to access, or read or monitor another person's messages, mail or devices without their permission;
- send spam, bulk or unsolicited messages, or harass, threaten, impersonate or defraud anyone;
- make purchases, bookings or payments that are fraudulent, or with payment methods you're not authorised to use;
- create or spread malware, phishing, or content that sexualises minors, promotes violence, or is otherwise unlawful;
- break websites' terms through automated access in ways that harm them, such as mass scraping, buying tickets or limited items with bots, or getting around rate limits, paywalls or CAPTCHAs;
- get around Bleu's approvals, safety checks or usage limits, or attack, overload or probe the Service;
- reverse engineer the Service except where the law allows, resell it, or use it to build a competing product;
- use output to make decisions with legal or similarly significant effects on others (such as employment, credit, housing or insurance) without human review.
We may suspend or end your access if you break these rules.
11. AI output
Bleu uses AI models that can make mistakes. Answers may be wrong, incomplete or out of date, and Bleu may misunderstand a request or take the wrong step on a website or app. Check important information and actions yourself. Bleu does not give legal, medical, financial or other professional advice. Output may be similar to output other users receive.
12. Intellectual property
Our property
We and our licensors own the Service, including the apps, software, designs and the Bleu name. We give you a personal, non-exclusive, non-transferable, revocable licence to use the apps to access the Service under these Terms.
Your content
You own what you give the Service and the data in your connected sources ("your content"). You give us a worldwide, non-exclusive licence to host, process, transmit and display your content only to provide, secure and support the Service for you. We don't use your content to train AI models.
Output
As between you and us, and to the extent the law allows, you own the output Bleu produces for you. We don't promise that output is original or free of others' rights.
Feedback
If you send us ideas or feedback, we may use them without paying or crediting you.
13. Copyright complaints
If you believe something on the Service infringes your copyright, send a notice to legal@usebleu.com with: your signature; the work you say is infringed; the material and where it is; your contact details; a statement of your good-faith belief that the use isn't authorised; and a statement, under penalty of perjury, that your notice is accurate and that you're the owner or authorised to act for them. We may end the accounts of repeat infringers.
14. Data export and deletion
You can ask for a copy of your Bleu Cloud data in a machine-readable format, or for your account to be deleted, at legal@usebleu.com. We'll respond within 30 days of verifying your request. Data on your Mac stays under your control.
15. Termination
You can stop using the Service and delete your account at any time. We may suspend or end your access if you break these Terms, if needed to protect the Service or others, if required by law, or if we discontinue the Service, and we'll give notice where reasonable. When your account ends, we delete your Bleu Cloud data and revoke the access we hold as described in the Privacy Policy. Sections 7, 8 and 11 to 24 survive.
16. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement. We don't warrant that the Service will be uninterrupted, secure or error-free, that output or actions will be accurate or complete, or that data from connected services will be correct.
17. Limitation of liability
To the fullest extent the law allows, we won't be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data or goodwill, or for actions taken by Bleu at your instruction or with your approval, even if we were told they were possible. Our total liability for all claims about the Service is limited to the greater of $100 or what you paid us in the 12 months before the claim. Some places don't allow these limits, so they may not all apply to you.
18. Indemnification
You'll defend and indemnify us, and our officers, employees and agents, against claims, losses and costs (including reasonable legal fees) arising from your use of the Service, your content, actions Bleu takes on your instructions or with your approval, your breach of these Terms, or your violation of law or anyone's rights.
19. Arbitration and class action waiver
Binding arbitration
You and we agree to resolve any dispute about the Service or these Terms by individual, binding arbitration administered by JAMS under its Streamlined Arbitration Rules, except that either of us may bring an individual claim in small claims court, and either of us may seek relief in court for infringement or misuse of intellectual property. Before starting arbitration, you agree to email us a description of the dispute and give us 30 days to resolve it informally. The arbitration will take place in Wilmington, Delaware, or by video, unless we agree otherwise.
Opt-out
You can opt out of this section by emailing legal@usebleu.com within 30 days of first accepting these Terms, with your name and the email you sign in with.
Class action waiver
Claims must be brought individually, not as a plaintiff or class member in any class, collective or representative proceeding.
Jury waiver
Where the law allows, you and we waive any right to a jury trial.
20. Export controls
You may not use the Service if you're located in, or ordinarily resident in, a country under comprehensive US embargo, or if you're on a US government list of restricted parties.
21. Governing law
These Terms are governed by the laws of the State of Delaware and applicable US federal law, without regard to conflict-of-laws rules. Any dispute not subject to arbitration will be heard in the state or federal courts in New Castle County, Delaware, and you and we consent to their jurisdiction.
22. Changes to these Terms
We'll post changes here and update the effective date. For material changes we'll tell you by email or in the app at least 30 days before they take effect. Using the Service after that means you accept the change.
23. General
- Entire agreement. These Terms and the Privacy Policy are the whole agreement between you and us about the Service.
- Severability. If a provision is unenforceable, the rest stays in effect.
- No waiver. Not enforcing a provision isn't a waiver of it.
- Assignment. You may not transfer these Terms. We may transfer them in a merger, acquisition or sale of assets.
- Force majeure. We're not liable for delays or failures caused by events beyond our reasonable control.
- Apple. If you got a Bleu app from Apple's App Store, Apple's standard licensed application end user licence terms also apply, Apple isn't responsible for the app or its support, and Apple may enforce these Terms as a third-party beneficiary.
